- CareDENT ha utilizado, sin autorización, el logotipo del Consejo General como aval de garantía de sus servicios odontológicos.
- Anuncia a sus odontólogos como “especialistas” a pesar de que en España no existen las especialidades oficiales en Odontología.
- Publicitan de forma ilegal productos sanitarios de uso exclusivo profesional.
Madrid, 21 de octubre de 2014.- El Consejo General de Colegios de Dentistas de España ha solicitado a una clínica de CareDENT que no utilice el logotipo del Consejo General en su página web (www.caredent-leganes-central.com) como aval de garantía de los servicios ofrecidos por dicha clínica.
El Consejo General quiere aclarar a la población que, en ningún momento, ha autorizado a ninguna clínica de CareDENT el uso de su logotipo ni para este fin ni para ningún otro.
Por otro lado, la citada página web de CareDENT ofrece información que podría inducir a error a la población ya que en ella se habla de “especialidades” y presenta a sus dentistas como “especialistas”, algo que no es correcto ya que en España no existen las especialidades oficiales en Odontología.
Por estos motivos, el Consejo General considera que CareDENT estaría divulgando una información engañosa al utilizar de forma indebida el logotipo del Consejo General para acreditar la calidad de los servicios odontológicos que ofrece. Asimismo, se estaría induciendo a error entre los pacientes al hablar de una supuesta especialización.
La citada página web también estaría vulnerando el artículo 78.6 de la ley 29/2006, de 26 de julio (“Ley del Medicamento”) al anunciar de forma indebida una información dirigida al público general relativa a dos productos sanitarios exclusivos para profesionales. Según esta ley, está prohibida la publicidad destinada al público general donde se promocionen o mencionen marcas comerciales de productos sanitarios que estén destinados a ser utilizados o aplicados exclusivamente por profesionales sanitarios.
El Consejo General de Dentistas adoptará las medidas legales que considere necesarias para defender sus derechos, para el resarcimiento de cuantos daños y perjuicios se pudieran causar, y garantizar a la población una información odontológica veraz.
